12 June 2017: SAVE THE DATE! Seminar on Property Law in Madrid, ES

Recent decisions of the EU court of Justice with origin in previous pre-judiciary claims from Spanish judges have led to recent law modifications and threaten to provoke that Spain goes from being one of the countries with the lowest interest rates to the contrary.

To discuss this challenge and the state of play in Europe, the Colegio de Registradores de España and the ELI-Spanish Hub are co-organising a seminar that will focus on various current issues related to the real estate credit market in Europe. Experts from Austria, France, Germany, Italy, Spain and the Netherlands will address presentations related to the state of play in their respective country with reference to:

•          Regime of the accelerated repayment term of the mortgage loan due to non-payment;

•          Legal regime of variable interest rate: ground clauses and ceiling clauses;

•          Terms found to be found unfair in mortgage credit contracts and procedures to declare its inefficacy

•          Mortgage execution procedure and objections to enforcement/grounds of opposition, and, if so, specialities of residential mortgage execution procedure.  

The seminar will be held in Madrid on Monday, 12 June 2017, at the Registrars’ Corporation located on Calle Diego de León 21, and will be exclusive to a maximum of 50 selected participants. After the presentations there will be time for discussion.
