Perspectives from the ELI Business Rescue Report, European Insolvency Regulation, and the UNCITRAL Legislative Guide

On the occasion of the 54th Session of the United Nations Commission on International Trade Law (UNCITRAL) Insolvency Law Working Group, the ELI cordially invites you to a panel discussion and an evening reception at the Austrian Ministry of Justice.

Stephan Madaus (Martin Luther University of Halle-Wittenberg, Germany) will introduce the ELI Instrument on Rescue of Business in Insolvency Law. Irit Mevorach (University of Nottingham, UK) will discuss Perspectives on the UNCITRAL Legislative Guide Part Three: Treatment of Enterprise Groups in Insolvency (2010), while Florian Bruder (Counsel at DLA Piper, Germany), will elaborate on the perspectives on the European Insolvency Regulation (2015) and Edward Janger (Brooklyn Law School, USA) will present the perspectives from the United States.

ELI Instrument on Rescue of Business in Insolvency Law

The Instrument was unanimously adopted by the ELI bodies in 2017. Bob Wessels and  Stephan Madaus acted as Reporters for this project. Based on extensive national reports, they prepared an Instrument with some 115 recommendations on the rescue of businesses in distress. In this EU-wide study they also looked into the treatment of corporate groups across Europe. The report is available here.

The event will take place on Tuesday, 11 December 2018, from 18:30 until 21:30 at the Austrian Ministry of Justice (Museumsstrasse 7, 1070 Wien).
