ELI Publishes Model Rules on Responsibility and Liability of Collective Entities for Criminal Offences

This groundbreaking framework provides much needed guidance to strengthen enforcement in the field.

On 8 May 2025, ELI Fellows formally adopted its Model Rules on Responsibility and Liability of Collective Entities for Criminal Offences. 

Drafted by Ms Celina Nowak, and Mr Fabio Nicolicchia, this groundbreaking statement offers a comprehensive framework to support courts, lawmakers, enforcement agents, regulators, and international bodies in addressing the challenges of enforcing corporate criminal liability.

Structured into five chapters comprising fourteen Articles, the Model Rules seek to establish a corporate governance framework that enhances accountability and facilitates more effective prevention and enforcement mechanisms in relation to organisational criminal liability.
