The forum brought together representatives of ministries of justice, judges, practitioners, academics to exchange views on emerging challenges and best practices in the enforcement of claims involving digital assets, including cryptoassets and other forms of tokenised value, with a particular focus on cross-border recovery and procedural effectiveness.
The event was chaired by Sir Geoffrey Vos (ELI Vice-President; Mater of the Rolls and Head of Civil Justice in England and Wales), who highlighted the importance of developing coherent and technologically informed enforcement frameworks capable of responding to the rapid evolution of digital assets and distributed ledger technologies.
The Forum featured a keynote intervention from Prof Dr René Repasi (European Parliament Member) who underlined the relevance of ensuring legal certainty and effective enforcement mechanisms at EU level in light of the increasing use of digital assets across markets and jurisdictions.
The keynote speech was followed by a presentation of the ELI Principles and Guidance for Enforcement Against Digital Assets by Co-Reporter and ELI President, Prof Dr Teresa Rodríguez de las Heras Ballel.
Rodríguez de las Heras Ballell explained that the Principles aim to provide practical and forward-looking guidance for courts and practitioners, addressing key issues such as the identification, freezing, and enforcement against digital assets, while ensuring procedural safeguards and legal certainty.
The Forum concluded with a broad discussion among participants, who exchanged perspectives on national experiences, implementation challenges, and the need for continued dialogue between legislators, judges, and practitioners to ensure effective enforcement in the digital economy.
