Admissibility of E-Evidence in Criminal Proceedings in the EU: Meeting of the PT, AC and MCC

The Project Team (PT), Advisory Committee (AC) and Members Consultative Committee (MCC) of the ELI project on Admissibility of E-Evidence in Criminal Proceedings in the EU met remotely on 27 September 2022 to discuss their final comments on the project’s draft legislative proposal.

Project Co-Reporter Lorena Bachmaier Winter presented the draft EU directive on mutual admissibility of evidence and e-evidence in criminal proceedings, which is being developed by the Team, as well as the progress made over the past two months, reflecting also on comments received during the ELI Annual Conference.

Participants provided helpful feedback on the draft, including on the definitions used and on the grounds under which evidence should be (absolutely) inadmissible in situations of cross-border transfers. The Project Reporters will revise the draft in light of feedback received both during the meeting and during the final evaluation of the project, with a view to submitting it for a vote to the ELI Council in December 2022.
