Austrian Hub Organises Monday Seminar on Competition for Talent

Can companies lawfully agree not to hire each other’s employees, or do such ‘no-poach’ pacts breach Article 101 TFEU? In June 2025, the European Commission imposed fines of EUR 329 million on Delivery Hero and Glovo for anti-competitive staff-hiring bans, – its first decision targeting a labour market cartel. Similar scrutiny is rising globally, with US authorities long enforcing a strict approach. The CJEU’s stance is awaited in the pending Tondela case on Portuguese football clubs. This talk will examine the Commission’s decision, compare international enforcement trends, and discuss the boundaries of competition law for labour market agreements in Austria.
