Background

ELI and the Global Partnership on Artificial Intelligence (GPAI) recently signed an agreement for ELI to contribute to GPAI’s project on Cogenerated Data. Under the above project, GPAI seeks to develop and implement guidelines for digital ecosystems to foster co-generation, sharing, and governance of AI technologies.

As part of this initiative, ELI has been invited, inter alia, to contribute by formulating guiding principles related to co-generation, sharing, and governance in digital ecosystems. This collaboration builds on ELI’s previous expertise, including work on data transactions and data rights.

 

Aim

ELI aims to, among other thing, develop principles for dealing with co-generation, sharing and governance in digital ecosystems, serving as a key reference for both academic and practical discussions on AI governance and to provide actionable recommendations for ensuring safe and trustworthy AI practices.

 

Outcome

The development of guiding principles for managing AI in digital ecosystems, which will be integrated into a broader project managed by GPAI, thus contributing to setting global standards for AI governance.

 

Final Approved Report and Principles

This project resulted in a main report, entitled Copyright and Data Protection Rights in Co-Generated Input and Output of Generative AI. This explores the legal landscape of ‘co-generation of data’, which refers to the use of data and content in Generative AI. Focusing on the legal frameworks of the European Union, the United States, and Japan, this report examines copyright and data protection considerations throughout the Generative AI lifecycle, including both co-generated input and output.

The main report complements the Copyright and Data Protection Rights in Co-Generated Input and Output of Generative AI: Principles, which are intended to be of a preliminary nature for such a fast-moving field – and neither exhaustive nor final. They aim to balance the interests of various parties involved with, or affected by, the development or deployment of Generative AI (Gen AI’), while fostering innovation and promoting responsible development of AI technologies.
