ELI Austrian Hub Held a Workshop on Collective Law Enforcement

On 28 November 2022, the ELI Austrian Hub held a workshop entitled ‘One for All? Workshop on the New Representative Action Directive’, as part of ‘Monday Seminar Series’, organised by Univ-Prof Dr Susanne Augenhofer, LL M (Yale), Univ-Prof Dr Alexander Schopper and Die Presse.

After a great deal of controversial discussion, the EU Representative Actions Directive was passed in late 2020 and has to be transposed by Member States by 25 December 2022. For the first time, the Directive will require Member States to introduce the possibility for qualified entities to sue for compensation on behalf of harmed consumers.

Key questions on the implementation of the Directive were discussed. Several stakeholders from the plaintiff/defendant spectrum, including Prof Beate Gsell (Ludwig Maximilian University of Munich), discussed their views on this topic.
