ELI Insurance Law SIG Held its Sixth Transatlantic Lecture on Insurance Law

On 19 May 2022, the ELI Insurance Law SIG organised its sixth transatlantic lecture on insurance law, dedicated to a transatlantic comparison of automobile insurance problems.

After a short introduction by Jeffrey W Stempel (Professor, University of Nevada Las Vegas), Jeffrey E Thomas (Professor) and Daniel L Brenner (Faculty Scholar, Professor, Associate Dean; University of Missouri) talked about ‘Conflict of Laws and Automobile Insurance: An American Perspective.’ A general overview of the US Legal System was offered, and an overview of the different tests for determining applicable law in situations where choice-of-law-issues arise was given.

In the second speech Helmut Heiss (Professor, Dr Dr hc, University of Zurich, Switzerland) talked about ‘International Jurisdiction for Direct Claims: Recent Developments in EU Private International Law.’ The focus was the relationship between Art 13(2) and Art 11(1) lit b) Regulation (EU) No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.

Frits J Blees (Dr Jur, formerly Managing Director of the Dutch Green Card Bureau and Guarantee Fund), spoke about ‘Motor Vehicle Third Party Liability Insurance and Claims Handling in a Multinational Environment.’ Blees gave insight into cross border traffic accidents as well as how to handle claims in Europe. He spoke about the advantages and disadvantages of two systems of facilitation of free movement and the protection of victims: the Green Card system and the 4th Motor Insurance Directive (MID).
