Spanish Hub Hosts its 9th Annual Meeting

07.06.2024

On 7 June 2024, the Hub held its 9th annual meeting on European Case Law at the University of Castille-La Mancha (Toledo).

The event was opened by an inaugural panel featuring Albert Ruda (Hub Chair, Girona), José Alberto Sanz (Dean, UCLM), Teresa Touriñán (Land Registry Association) and Aneta Wieworowska (ELI Executive Committee Member).

Keynote speakers included Prof Oreste Pollicino (Bocconi) and Prof Ángel Carrasco (Toledo), in a session chaired by Maria L Kubica (Hub Chair, U Complutense, Madrid). Thematic panels presented papers on evidence (Jordi Ferrer and Carmen Vázquez, Girona), AI models (Carmen Muñoz, U Complutense, Madrid) and cognitive manipulation in consumer law (Luz Martínez).

The 9th annual meeting reviewed the Court of Justice of the European Union’s (CJEU) and European Court of Human Rights’ (ECtHR) case law. Each panalist selected a recent court decision for commentary from a Spanish law perspective. The event included 20 parallel sessions with 118 papers and 6 keynotes presented both face-to-face and online. Consumer law had the most panels (3), followed by digital law (2) and tax law (2). A special session with 2 panels on land registry law was held in collaboration with the Spanish Land Registry Association.

These papers examined the alignment or divergences of European case law with Spain’s domestic law. Keynotes discussed CJEU’s case law on data protection (Pollicino) and consumer protection (Carrasco). The inaugural session highlighted the digitalisation of land registry law (Touriñán) and ELI’s projects in consumer law (Wieworowska). Other analyses included AI compliance and tort issues (Muñoz), dark patterns in consumer contracts (Martínez) and evidence assessment by appellate courts (Ferrer and Vázquez).

There were approximately 127 registered participants. The papers will be published in a book edited by Albert Ruda and María Kubica and coordinated by Yohan A Campos with Tirant lo Blanch (a major publishing house in Spain).
